Two Years. Within Arizona, there is a two-year time limit for filing a personal injury claim. The law states that a plaintiff must start a claim within two years of the date of the cause of action for cases involving wrongful death, robbery, trespassing, medical malpractice and personal injuries.

“Generally, service of process must be made by a sheriff, a sheriff's deputy, a constable, a constable's deputy, a private process server certified under the Arizona Code of Judicial Administration §7-204 and Rule 4(e), or any other person specially appointed by the court.

Dollar Amount Limits The justice courts have exclusive jurisdiction (authority) to hear all civil actions when the amount involved is below $10,000 not including interest, costs and awarded attorney fees. Parties with claims for less than $3,500 should consider filing in the Small Claims division of justice court.

Enforcing a Judgment. A copy of the written decision (judgment) will be mailed to each party. After you have received your copy of the judgment, make a written demand of the other party to pay the judgment amount. If they do not pay, at your request the court may provide you with forms you may file to try to collect.

If a defendant is not served with process within 90 days after the complaint is filed, the court--on motion, or on its own after notice to the plaintiff--must dismiss the action without prejudice against that defendant or order that service be made within a specified time.

Civil Law The plaintiff files a document (complaint) with the clerk of the court stating the reasons why the plaintiff is suing the defendant, and what action the plaintiff wants the court to take. A copy of the complaint and a summons are delivered to (served on) the defendant.
