Tiny houses on foundations are allowed in the state of Maryland and are treated under the same rules and regulations as any traditional dwelling under the State's building codes.

Under the Montgomery County law, all ADUs must meet certain requirements, including: There can be only one ADU per lot. The owner of the property must live in either the principal dwelling unit or the ADU. New ADUs must be licensed by the Department of Housing and Community Affairs.

The maximum living area allowed for ADUs varies. In Montgomery County, the size of an ADU is limited to 1,200 square feet (unless the basement footprint is bigger and the basement is intended as an ADU).

ADU's are permitted in single family, duplex or townhouse units as integrated ADUs or as separate structure on single family, duplex, or townhouse lots. Only one ADU is permitted per lot. Unless the lot has excess parking, a parking space for the new unit will be required.

ADU is smaller than the house and it must contain permanent provisions for living, sleeping, eating, cooking and sanitation. ADUs can be created by altering a portion of a main existing house, including a garage, adding to an existing house, or constructing a new detached building on the same lot.
