A set-aside can only be issued by the court. An individual with a DUI conviction can “apply to the judge, justice of the peace or magistrate who pronounced sentence or imposed probation” or another in office to have the conviction set-aside. The court will then review a variety of factors before granting a set-aside.

If you have been convicted of a criminal offense, upon fulfillment of the conditions of probation or sentence, and discharge by the court, you may apply to the judge who pronounced sentence to have the judgment of guilt set aside.

§ 13-907 prescribes the method by which certain criminal convictions may be “set aside.” You should be aware that pursuant to A.R.S. § 13-907(D), the set aside does not apply to a person who was convicted of a criminal offense: 1. Involving a dangerous offense. 2.

Under A.R.S. § 13-907, most people in Arizona who are convicted of crimes are allowed to file motions to ask the court to set their convictions aside. In order to file a motion for this to happen, a convicted person must first complete his or her probation or sentence.

In order to clear your record in Arizona, you may petition the court to enter on your record that you have been cleared of all charges. If successful, the judge will order all law enforcement agencies and courts to cease from distributing your arrest record to anyone. The arrest will be treated as if it never occurred.

Typically, it takes about 3 to 4 months to expunge an Arizona record. We will file your petition as quickly as we can, but the timeframe can vary depending on the specifics of your case, including how long ago your case was and whether the DA objects to the set aside.

In order to file a motion for this to happen, a convicted person must first complete his or her probation or sentence. After the sentence has been discharged, the person can then file a motion to request that the court set his or her conviction aside. The request will not automatically be granted.

Under ARS 13-905, except for certain disqualified convictions, after you have completed your sentence, then you may file an application with a judge to have your conviction set aside. You can apply even if you have multiple felony or misdemeanor convictions on your record.
