You must file an Assessment Appeal Application, form BOE-305-AH, obtained from the clerk of the board of the county where your property is located. Some counties have this form available on the website of either the clerk of the board or the county assessor, or both.

If a taxpayer disagrees with the value established for a property, they should discuss the issue with the Assessor's staff in the county where the property is located. If an agreement cannot be reached, then taxpayers have a right to appeal the value under certain circumstances and limitations.

In order to be timely, it must be filed within 45 days. Pursuant to Revenue and Taxation Code section 532(b)(2), the applicable statute of limitations period for such unrecorded changes in ownership is eight years after July 1 of the assessment year in which the property escaped taxation.

So long as the individuals and the legal entity have the same proportional ownership interests, the real property will not be reassessed when transferred to or from the entity or the individual. A and B can transfer property owned by them 50/50 to an LLC owned by them 50/50 without reassessment.

All appeal applications must be filed with the Clerk of the Board, Administration Bldg. 5th Floor, 1221 Oak Street, Oakland 94612. These forms may be obtained by calling (510) 272-6352 or visiting .acgov.org/clerk/assessment.htm.

Any construction project that raises the quality class or extends the useable life of the property are considered assessable. These “like new” or substantially equivalent to new renovations involve more substantial structural changes.
