In the state of Michigan, child support is mandatory. The amount of child support that a parent is required to pay can vary based on factors such as the income of both parents, the number of children involved, and the custody arrangement.

When you file something with the court, you must give the other party in your case (or their lawyer, if they have one) a copy of what you filed. This is called service. Every time you serve the other party, you must give the court proof that you did so. This is called proof of service, or proof of mailing.

Welcome to Michigan's Friend of the Court, a part of the circuit court family division supervised by the chief judge. The Friend of the Court assists the court administrator on issues of custody, parenting time and support, including medical and spousal.

Unlike mediation, if the parties do not agree on the issues, the FOC worker may prepare a recommended order. The FOC will send the recommendation to the judge and both parties. A Friend of the Court recommendation usually will become a court order if neither party objects to it on time.

The Uniform Support Order was designed to discontinue support for each child on the last day of the month when the child attains age 18 unless the court sets a different end date for an individual child.

The summons and complaint can be served by sending them by certified mail with restricted delivery and return receipt. A “green card” (PS Form 3811) will be mailed to the plaintiff, to show proof of service. The “green card” or a copy, must be filed with the Court. Service of Summons.

You have the right to refuse friend of the court services for custody, parenting time, and support. To decline friend of the court services, you must file with the court a motion requesting that friend of the court services not be required. You must attach a signed copy of this advice of rights to the motion.

The Friend of the Court (FOC) serves as the enforcement and investigative arm of the Circuit Court Family Division. FOC employees are court employees.

Michigan Custody Laws for Unmarried Parents There are exceptions to this rule in cases where the court already made a prior custody ruling, but for the most part, by default, child custody is presumed to be with the mother in the absence of a marriage or previous legal agreement.
