Can I break my lease? You are always able to break a lease; there is little a landlord can do to actually stop you from leaving before the full term specified in the lease. You are violating no law by vacating early, but you are violating the terms of the contract between you and the landlord.

A New Hampshire month-to-month rental agreement is a contract between a landlord and tenant that can be terminated with a minimum of 30 days' notice. Also known as a 'tenancy at-will', this type of arrangement is for a short-term arrangement or if both parties do not know when the tenancy will end.

If your lease expires and you are not offered a new one, you become a month-to-month tenant. If you do not have a lease, the landlord can increase the rent, but must give written notice of the increase (or any other significant change), 30 days in advance.

A landlord can legally evict a tenant only by sending a written notice to the tenant. This written notice must be in the form of a "written notice to quit or leave" which is a legal document. Eviction for not paying rent, damages to the property or danger to the health or safety of others require seven days' notice.

Fixed-term lease This is probably the most common type of residential lease, and guarantees your tenancy (and your monthly rental cost) for a set period of time—for example, six months, a year, or two years.

Rent is usually considered late a day past it is due. A grace period may be available if stated in the lease/rental agreement. Before they can start the eviction process, a landlord must give the tenant an official written 7-Day Notice to Quit.

To end a month-to-month tenancy without legal cause, the landlord must give the tenant a written 30-day notice to quit. The landlord must also have good cause to end the tenancy, but New Hampshire law defines good cause very broadly, including economic or business reasons.
