If you have been served an eviction notice, the eviction lawsuit would naturally come next. To avoid lawsuits, some tenants choose to leave. However, the landlord may still file a lawsuit or get a collection to get the money if tenants fail to give them the amount they owe.

In an unlawful detainer lawsuit, the landlord is the plaintiff and the tenant is the defendant. The matter will be set for trial and unless settled before the trial the court will decide if the landlord may oust the tenant and regain possession of the property.

If you don't move after receiving proper notice (or else reform your ways for example, by paying the rent or finding a new home for the dog), the landlord can file a lawsuit to evict you. This type of lawsuit is sometimes called an unlawful detainer, or UD lawsuit.

If a tenant does not pay the outstanding rent by the fourteenth day, they have 16 days to vacate the property. If a tenant does not leave the property by the end of the 16-day period (30 days after the landlord delivered the notice to quit) the landlord can go to court to request a detainer warrant for the tenant.

(1) With the exception of an emergency hearing, preliminary hearing, or detention hearing, if a party to be served with a summons is within this state and can be found, the summons shall be served upon the party personally at least 3 days before the hearing.

Generally, process servers make at least three attempts to serve somebody. These attempts are normally made at different times of day and on different days to maximize our chance of serving the papers.

Detainer Warrant is the leading process of General Sessions Court, used by a plaintiff in order to regain possession of his/her real property from a defendant, usually one who has failed to pay rent. This warrant has a 30-day limit and the Court date is to be set at least six days from the date of service.

Eviction Process If the tenant has not paid rent or fixed the lease violation within the 14-day time period, the landlord can terminate the rental agreement and file an eviction lawsuit in the general sessions court. The landlord will file a summons and complaint, and then the tenant will receive a copy of both.
