If you have been convicted of a felony in Alabama, you are not legally allowed to own or possess a firearm.

To be eligible for a pardon, a person must have completed his or her sentence or completed at least three years of permanent parole before filing an application with the Alabama Board of Pardons and Paroles. However, a pardon sought on grounds of innocence may be filed earlier, with several restrictions.

You have no pending criminal felony charges. You have paid all fines, court ordered costs, fees, and restitution ordered at the time of sentencing on disqualifying cases in full. Your sentence has been completed. You have successfully completed probation or parole.

Alabama Code Section 15-27-4 requires the payment of a filing fee, when filing a petition for expungement in the appropriate circuit court. The administrative filing fee is $500.00; however, when a petitioner is seeking expungement of multiple charges arising from one arrest, only one filing fee is required.

The Board may grant a full pardon, which restores all rights, or they may grant a pardon with restrictions. For example, the Board may restrict the right to possess a firearm and/or they may require that an applicant convicted of a sex offense continue to comply with all sex offender restrictions.

To apply, you can contact your local state Probation and Parole office in the county where the applicant lives, or you can contact the Board of Pardons and Paroles main office by phone, mail, email, or in person.
