You can file a Dispute Note that indicates that you agree you owe the amount claimed in the Civil Claim. It is likely that the Court would then order that Judgment be issued against you.

Once you receive the particulars of the claim, make sure you respond within 14 days of receiving them. If your response is not received within 14 days, the court can either make an order that you pay the amount claimed or decide the amount you are liable for. This is known as a county court judgment.

The Dispute Note may be filed with any Provincial Court Office in Alberta, either in-person or by mail, but it is recommended that Dispute Notes be filed at the Court location identified on the Civil Claim. Once the Dispute Note is received by the Court, each party will receive a Notice setting out the next steps.

The steps include: Filing a Civil Claim at the courthouse; Serving the Civil Claim on opposing party within one year from filing date; Filing an Affidavit of Service with the courts; and lastly. The defendant then has 20 days from the date he/she was served to file and serve a defence, also called a Dispute Note.

Your Affidavit of Service must be completed by the person who served the documents. The person who served the documents must swear the Affidavit of Service is true before a Commissioner for Oaths or Notary Public. The Affidavit of Service will: explain who delivered the documents.

If a Request to Note in Default is filed against a party on a Civil Claim that is not for a debt or liquidated demand, the Court may award costs for steps taken up to Judgment. This may include costs that the party has incurred for filing the Civil Claim, service of the Civil Claim, and registry searches.

A party must complete and file an Affidavit in Support of Substitutional Service. The Affidavit needs to specify how the documents will be substitutionally served and why, if served in the requested manner, they would come to the attention of the other party.
