PERM Application Process To obtain a permanent labor certification, employers must file Form 9089 (officially called the “Application for Permanent Employment Certification”). The PERM application may be filed in several different ways, depending on the circumstances.

An employer who desires to apply for a labor certification, for occupations other than sports, on behalf of an alien must file Form ETA 9089.

Unfortunately, the ETA-750B form expired on 30th June 2017. Applicants may no longer choose between these two forms – they now must file form ETA-9089. As with other NIW updates, I wanted to let you know about this important change.

An ETA 750b Form is better known as an Application for Alien Employment Certification. Processed by the US Department of Labor, this form is completed by individuals who live in foreign country and would like to come to the United States for either temporary or permanent employment.
