WHAT IS A SMALL CLAIMS COURT? In Florida, a County Court now handles what was once called small claims court. By statute and court rules, a less formal and less complicated procedure is available for small claims, that is, claims of $8,000.00 or less.

In addition to just appearing at the appointed time, the Defendant may also file documents with the court. These include, but are not limited to, a Motion to Dismiss, an Answer, an Affirmative Defense, a Counterclaim, and a Third-Party Complaint.

After filing, each person or business being sued must be served with a summons/notice to appear in court on a date and time scheduled when the initial claim was filed. A copy of the Statement of Claim should be attached as provided in the Florida Small Claims Rules.

To file or defend a case in small claims court, you must be (a) at least 18 years old or legally emancipated, and (b) mentally competent. A person must be represented by a Guardian ad Litem if he or she is under 18 and not legally emancipated, or has been declared mentally incompetent by a court.

How long you have to file a claim in court, notably Small Claims Court, varies depending on the topic and circumstances of the respective litigation. Chapter 95.11, Florida Statutes, explains that a person has between one and five years.
