On November 25, 2002, Congress passed the Maritime Transportation Security Act of 2002 (MTSA), giving the Department of Homeland Security (DHS), and specifically the U.S. Coast Guard (Coast Guard), the authority to regulate facilities and vessels located on or adjacent to waterways under U.S. jurisdiction.

IMPLEMENTATION OF THE MARITIME TRANSPORTATION SECURITY ACT The Maritime Transportation Security Act of 2002 (MTSA), signed on November 25, 2002, by President Bush, is a landmark piece of legislation that is designed to protect the nation's ports and waterways from a terrorist attack.

MTSA-regulated facilities need to assess, identify and develop a set of risk-based security measures to address cyber risk and demonstrate that their facilities have a cybersecurity plan in place that mitigates the risk of cyber attacks on critical infrastructure.

As of January 2021, there were 2,776 facilities subject to the MTSA, of which 2,386 require Facility Security Plans (FSP). Approximately 203 additional facilities have a valid approval letter for an Alternative Security Program (ASP).
