What is GWUDI? GWUDI is an anacronym for “ground water under direct influence” of surface water. This means that the groundwater source (i.e. well, spring, mine, etc.) is located close enough to nearby surface water to receive direct surface water recharge.

Texas landowners actually have three types of rights under the Rule of Capture. One is the right to try to capture groundwater, the second is the right to the water actually brought to the surface and captured and the third is the right to use or sell this water. All three rights can be sold, or leased to others.

“The system must maintain a minimum pressure of at least 35 psi throughout the distribution system during normal operations, and a minimum of 20 psi during emergencies, as specified in 30 TAC 290.46(r).

The TCEQ has regulatory authority over several of the federal and state identified critical infrastructures and key resources (CI/KR), including water supply systems, wastewater treatment plants, chemical plants, low level radioactive waste, refineries, and dams.

Change of Ownership requests may be submitted directly to WRCOO@tceq.texas.gov. If your files are too large to be submitted via e-mail, TCEQ's FTP may be utilized. Please visit the FTP help site for more information on how to transfer.

Groundwater in Texas is governed by the legal doctrine known as the Rule of Capture. The Rule of Capture essentially provides that because a landowner also owns the water beneath his property, the landowner has the right to pump as much water as he wishes even at the expense of his neighbor.

In Texas, anyone who wants to use surface water must first get permission from the state, unless they are using the water for one of several “exempt uses” in the Texas Water Code.

The Groundwater Rule protects your drinking water quality and provides additional protection from disease-causing microorganisms. Water systems that have groundwater sources may be susceptible to fecal contamination which can contain disease causing pathogens.
