SUBPOENA. Every subpoena shall be issued by the clerk, shall state the name of the court and the title of the action, and [shall] command each person to whom it is directed to attend and give testimony at the time and place and for the party therein specified.

A subpoena is an order compelling a person to appear to testify or produce documents (called a subpoena duces tecum when requesting documents). Any party related to an APD case may request subpoena(s) from APD by e-mail to APDSubpoena.Request@tn.gov.

With the exception of emergency hearings, preliminary hearings, detention hearings, or for good cause shown, all subpoenas for the attendance of witnesses shall be served at least 5 calendar days prior to the hearing.

(1) A party or attorney responsible for issuing and serving a subpoena must take reasonable steps to avoid imposing undue burden or expense on a non-party witness subject to the subpoena and shall provide the non-party witness at least twenty-one (21) days after service of the subpoena to respond, absent agreement of ...

A subpoena may be served by any person authorized to serve process or the witness may acknowledge service in writing on the subpoena. Service of the subpoena shall be made by delivering or offering to deliver a copy to the person to whom it is directed in ance with this or any local rule.

Rule 45(c) allows service of a subpoena to be made by any non-party who is over 18 years of age. This s with G.L. c. 238, § 2 which allows service of a summons to be made "by an officer qualified to serve civil process or by a disinterested person." Both statute and rule thus permit service by a party's attorney.

A subpoena requiring the attendance of a witness at a hearing or trial may be served any place within Tennessee. (g) Contempt. When a subpoena is served on a person, the court issuing the subpoena may deem the person's refusal to obey the subpoena to be contempt of court unless the person has an adequate excuse.
