Maryland, the lone holdout, worried that Virginia could claim large swaths of land west of the Ohio River. Hoping to limit the size of their neighboring state, Maryland refused to ratify unless all states ceded their claims to Western land and relented them to the national interest.

The landless states wanted the Articles to stipulate that Congress limit the boundaries of those states claiming western lands. Under their proposal, Congress would take ownership of the western lands and sell off them off, using the money to benefit all by paying off war debts.

Between 1781 and 1785, the "landed" states ceded their western land claims to Congress. Virginia ceded the single largest area to the national government. Known as the Northwest Territories, it comprised the present-day states of Illinois, Indiana, Michigan, Ohio, and Wisconsin, as well as part of Minnesota.

They needed land to reward the soldiers who served in their regiments against the British. Maryland also feared that if Virginia and the other land-claim states took title to lands in the trans-Appalachian West, they would dominate the nation economically and politically.

Because of disputes over representation, voting, and the western lands claimed by some states, ratification was delayed. When Maryland ratified it on March 1, 1781, the Congress of the Confederation came into being.
