How Long Does the Affirmative Asylum Process Take? A decision should be made on your asylum application within 180 days after the date you filed your application unless there are exceptional circumstances.

This form is used to apply for asylum in the United States and for withholding of removal (formerly called "withholding of deportation"). This application may also be used to apply for protection under the Convention Against Torture.

Asylum offices have a statutory duty to schedule an asylum interview within 45 days of the initial filing; the entire case must be completed within 180 days (the time it takes for a person with a pending asylum application to procure an employment authorization card). INA § 208(d)(5)(A)(ii) & (iii).

In order to be granted asylum, an individual is required to provide evidence demonstrating either that they have suffered persecution on account of a protected ground in the past, and/or that they have a “well-founded fear” of future persecution in their home country.
