Substantial Completion vs. Substantial completion and final completion are the two final phases of a project. Substantial completion refers to when the building can be used for its intended purpose. Final completion occurs when the project is 100% complete and requires no additional work.

Substantial performance is a contract law doctrine that allows parties to be paid under a contract and to retain the benefit of a contract even if they technically failed to comply with the precise terms of the agreement.

A party can assert substantial performance when there is only slight deficiency under the contract terms, a good faith effort was made to reach full performance, and there was no material breach. Basically, the outcome will be sufficient enough to warrant payment for services rendered.

A head contract, contract or subcontract is substantially performed if the work to be done under that. contract can be completed or corrected at a cost of not more than. a) 3% of the first $500,000 of the contract price b) 2% of the next $500,000 of the contract price, and c) 1% of the balance of the contract price.

Definition of “Substantial Performance” under Ontario's Construction Act Three percent of the first $1,000,000 of the contract price, Two percent of the next $1,000,000 of the contract price (if applicable), and. One percent of the balance of the contract price (if applicable).

In Ontario, there is the Construction Act. This allows anyone supplying service or materials to put a lien on the property. This applies to anyone who provides services for either the owner, a contractor or even a subcontractor. The only exception to this is if the owner is the federal or provincial crown.
