What is Voluntary Departure? ➢ Voluntary Departure allows you to leave the U.S. at your own expense within a specific amount of. time in order to avoid a deportation order. ➢ There are two types of Voluntary Departure: “pre-conclusion Voluntary Departure” and “post- conclusion Voluntary Departure.”

This means that you will be subject to involuntary removal from the U.S. If you leave past the date that you were supposed to leave under the voluntary departure order, your departure is considered a self-removal, meaning that you will be considered to have been deported.

Civil Penalty for Failing to Depart the U.S. After an Order of Voluntary Departure. A non-citizen who fails to depart the United States within the time period specified in the voluntary departure order becomes subject to civil penalties. You might have to pay a civil monetary penalty of between $1,000 and $5,000.

In case of a departure order, local authorities tell foreigners to leave the country by a certain date and trust that they will do so voluntarily. But a deportation order requires authorities to take action to enforce it, for instance, taking physical custody of the subject.

How is voluntary departure different from deportation? Deportation occurs when DHS removes you from the United States to the country of your citizenship, whether you want to be removed or not, whereas voluntary departure occurs when you receive permission to leave on your own.

To be eligible for voluntary departure at this stage, you must admit that you are removable from the U.S., waive your right to immigration relief or an appeal, and make the request at your first hearing in immigration court. This is known as the Master Calendar hearing.
