(a) A child support lien attaches to all real and personal property not exempt under the Texas Constitution or other law, including an account in a financial institution, a retirement plan, including an individual retirement account, the proceeds of a life insurance policy, a claim for negligence, personal injury, or ...

A lien is a charge against property or other assets. By putting the order or judgment in the official records the public is put on notice that the paying parent owes money. The recording creates a lien - usually equal to the child support arrears - against any real property owned by the paying parent.

The claim of the Department for a support debt, not paid when due, shall be a lien when docketed against all property of the debtor in the county or city where docketed with priority of a secured creditor.

10. Does a child support lien or abstract ever expire? No, as long as the child support debt is owed the lien or abstract remains active. The California Civil Code exempts support judgments from renewal requirements and the support order or judgment is enforceable until paid in full.

Under Texas law, the statute of limitations for seeking back child support when a court order is already in place is ten years from the child's 18th birthday. If a claim isn't filed by the deadline, then any recovery for back child support in Texas may be denied.

The court may issue fines of up to $500 for every nonpayment. File liens against their assets. A Texas court could issue a jail sentence for up to six months for contempt of court due to unpaid child support. The court could order the other parent to pay your attorney and legal fees.

Notice of Lien (1 TAC 55.119(a)) This form serves notice that a custodial parent has placed a lien on a noncustodial parent's property for unpaid child support. The lien shows a right to keep possession of property belonging to the noncustodial parent until they pay their owed child support.
