The formula for the calculation of spousal support is 40% of the difference between the parties' net incomes without dependent children and 30% with dependent children.

The Uniform Marriage and Divorce Act, on which many states' spousal support statutes are based, recommends that courts consider the following factors in making decisions about alimony awards: The age, physical condition, emotional state, and financial condition of the former spouses; ... The length of the marriage; and.

There is no firm dollar figure for spousal support. The amount should be decided by both parties. Some common ways of calculating spousal support are to take up to 40% of the paying spouse's net income (post-child support), less 50% of the amount of the supported spouse's net income (if he or she is working).

If the alimony is being paid on a monthly basis, the Supreme Court of India has set 25% of the husband's net monthly salary as the benchmark amount that should be granted to the wife. There is no such benchmark for one-time settlement, but usually, the amount ranges between 1/5th to 1/3rd of the husband's net worth.

The financial means, needs and circumstances of both spouses; The length of time the spouses have lived together; The roles of each spouse during their marriage;

Some common ways of calculating spousal support are to take up to 40% of the paying spouse's net income (post-child support), less 50% of the amount of the supported spouse's net income (if he or she is working). Spousal support can be waived by the recipient spouse.

To calculate alimony, 25 percent of the recipient's net income is subtracted from 33 and one third percent of the payor's net income. However, the sum of the recipient's income and the maintenance payments is limited to 40 percent of the couple's combined net income.

Deduct (subtract) these things from each parent's income: Combine (add) the incomes of both parents after making those deductions, and multiply the total you get by the correct percentage: Divide the figure you get between both parents according to both your incomes (on a pro rata basis).

First, you and your spouse can agree to change the amount and/or duration of alimony. If this happens, you should enter into a written contract that spells out the new agreement, and ask the judge to turn the agreement into an official court order. If you can't agree, you'll have to head to court.
