Filing a Motion via E-filing You can e-file using a personal computer or at one of the public access eFile workstations offered at the Daley Center and in suburban courthouses. You must have an email address to e-file.

The “notice of motion” is where the court clerk inserts the date, time, and place the motion will be heard by the judge. When you “serve” (mail) the motion to the other side, the notice notifies the other side when the hearing will be held.

An answer or motion with respect to pleadings must be filed within twenty one (21) days after the date of the filing of the petition or the Rule 19A.

Every motion filed must cite legal authority supporting the motion and the relief sought. The body of any motion must state if the motion is joint, or if the other parties have authorized the movant to state that the parties either agree to the motion or have no objection to it.

Your motion/petition must include a Notice of Motion, which must be filed with the Clerk of Court. The notice of motion will state the name of the case, case number, name of your motion and the date, time and place for hearing (including the name of the judge), and a brief description of your motion or petition.

Letters of office. Letters of office, which are certified proof of the guardian's appointment, are usually issued by the Probate clerk within a day or two of the appointment and are mailed to the petitioner's attorney or to the appointed guardian.

The Petition to Terminate the Guardianship must allege that a material change in the circumstances of the minor or the parent has occurred since the entry of the order appointing the guardian. The Petition must contain factual details showing the change of circumstances.

In order for a guardian to be appointed, a petition must be filed in the court by an "interested person". The petition includes basic information, such as the name, date of birth and address of the person alleged to be in need of guardianship.
