Indiana employers must provide a child less than eighteen (18) years of age one (1) or two (2) rest breaks totaling at least thirty (30) minutes if the child is scheduled to work at least six (6) consecutive hours.

Restrictions on Hours Worked for Minors 14 and 15 Years Old Minors 14 and 15 may only work from 7:00 am until 7:00 pm, and must work outside of school hours. From June 1st through Labor Day, minors may work until 9:00 pm so long as the night is not followed by a school day.

Update to Indiana's Work Permit Laws: 3/16/2021 Effective 7/1/2021, Indiana will no longer require work permits for minor employees. Employers will no longer be required to complete the “Intent to Employ” form, and schools will no longer issue work permits.

Congress passed the Fair Labor Standards Act in 1938 regulating the employment of those under 16 or 18 years of age, and the Supreme Court upheld the law.

Minors ages 16 and 17 may only work up to nine hours per day, up to 40 hours per school week, and up to 48 hours per non-school week. Minors ages 16 and 17 may also not work more than 6 consecutive days. Minor employees ages 16 and 17 also have more complex restrictions on shift lengths and start times.

Effective July 1, 2021, Indiana eliminated work permits completely, and now requires all employers with five or more minor employees (under age 18) to use Indiana Department of Labor's Youth Employment System (YES) to track and report minor-employee information.

The rules vary depending upon the particular age of the minor and the particular job involved. As a general rule, the FLSA sets 14 years old as the minimum age for employment, and limits the number of hours worked by minors under the age of 16.
