13th Salary There are no statutory requirements for 13th-month salary payments. However, bonuses are common at the discretion of the employer.

The payment is required to be made on or before December 24 of every year. While most employers choose to pay their employees at the end of the year, others can give their pay twice a year (in June and in December).

Employees who do not receive their 13th-month pay have various legal avenues available to them. These may include filing a complaint with the Department of Labor and Employment (DOLE), or pursuing a case before the appropriate judicial body for breach of contract or violation of labor laws.

Prorated 14th Month Pay. For employees employed for less than one (1) year, their 14th month pay shall be prorated ing to the number of months served. In no case shall the 14th month pay be less than 1/12 of the employees' total basic monthly salary.

To compute your 13th month pay, multiply your basic salary by the number of months you have worked for the year to get your total basic salary. For this example, P30,000 multiplied by 9.5 months is equal to P285,000. Now, divide your P285,000 total basic salary by 12 months. Your 13th month pay will be P23,750.
