Like the Miranda warnings so well recognized in the United States, Great Britain has a caution that is familiar to its citizens. This warning, referred to as the right to silence, has been used for three decades.

In the seminal case of New York v. Quarles, the Supreme Court said that an officer's concern for public safety can justify a failure to give Miranda warnings. (467 U.S. 649 (1984).)

However, in New York v. Quarles, the Court recognized the need for an exception to Miranda when police must defuse an immediate threat to public safety and declared that this outweighs the fifth amendment privilege against self incrimination.

In a 5-4 Supreme Court decision Miranda v. Arizona (1966) ruled that an arrested individual is entitled to rights against self-discrimination and to an attorney under the 5th and 6th Amendments of the United States Constitution.
