For a Will to be valid in Alabama, the testator must be 18 years or older and competent to create a Will. The Will must be in writing, signed by the testator, and signed by two witnesses.

Alabama does not recognize oral (nuncupative) wills. Also, unlike some other states, Alabama does not permit handwritten and unwitnessed (holographic) wills; Alabama has made it a legal requirement that a will must be signed and witnessed by two people in order to be a valid will. Ala. Code § 43-8-131.

A Will should be written while the maker is in good health and free from any emotional distress. A prudent person does not wait for a catastrophe or other compelling reason to make a decision. The state of Alabama does not allow digital-only wills. The will must be signed by at least two witnesses; in the state of Alabama, the witnesses are not required to be “disinterested” parties, so the witnesses can also be beneficiaries of the will.

To be valid, a Will must be in writing. It must be signed, dated, and witnessed ing to all the formal requirements of execution in Code of Alabama §43-8-131. The testator must have testamentary capacity and sign voluntarily.
