Since January of 1999, landlords have had the right to set the initial rent for new tenancies, and subsequent rent increases in units fully covered by the Rent Ordinance are limited by the law. This type of rent control is known as vacancy decontrol.

As of October 29, 2022, Berkeley's eviction moratorium includes evictions under the Ellis Act.

The Berkeley Rent Ordinance requires just cause for eviction: Under the Berkeley Rent Ordinance, a landlord shall not be entitled to recover possession of a rental unit, which includes any housing services connected with the property, unless the existence of one of 11 grounds set forth in section 13.76.

(Rent Board Regulation 1013(O).) If tenants hide the fact that the last original occupant has vacated the unit, however, the landlord's acceptance of rent does not constitute a waiver of the right to implement a vacancy increase.

Berkeley Municipal Code § 13.76. 110. To increase the rent, landlords must serve written rent increase notices that provide 30 days' notice where the rent increase is less than ten percent. California Civil Code § 827. For rent increases of ten percent or more, the landlord must provide 90 days' written notice.

Beginning January 1, 2023, landlords may raise rent ceilings by 4.4% for all tenancies starting prior to January 1, 2022, after giving tenants a proper written notice of rent increase. Proper notice is: 30 days for rent increases of 10% or less. 90 days for rent increases of more than 10%.

There are over 19,000 rental units in Berkeley with regulated rents. Since January of 1999, landlords have had the right to set the initial rent for new tenancies, and subsequent rent increases in units fully covered by the Rent Ordinance are limited by the law.
