What is eNC3? North Carolina law requires all employers and other payers, who are required to or voluntarily withhold North Carolina income taxes, to file Form NC-3 and the required W-2 and 1099 statements electronically using the eNC3 and Information Reporting Application.

During the calendar year, if you terminate your business or permanently cease paying wages, non-wage compensation, and pension payment subject to North Carolina income tax withholding, Form NC-3 and the required W-2 and 1099 statements must be filed within 30 days of the last payment.

If you are unable to file Form NC-3 and the required statements electronically, mail this form and the required statements with your check or money order to: North Carolina Department of Revenue, PO Box 25000, Raleigh, North Carolina 27640-0001.

Penalties. A taxpayer will be assessed a penalty of $50 per day, up to a maximum of $1,000, for failure to file the informational return by the date the return is due. A taxpayer will be assessed the $200 penalty for failure to file Form NC-3 in the format prescribed by the Secretary.

Every partnership doing business in North Carolina must file a partnership income tax return, Form D-403, for the taxable year if a federal partnership return was required to be filed. (Exception: A partnership whose only activity is as an investment partnership is not considered to be doing business in North Carolina.
