5 CCR Section 3200 provides the following definitions: (b) 'Complainant' means any individual, including a person's duly authorized representative or an interested third party, public agency, or organization who files a written complaint alleging a violation of any of the provisions within the scope of section 3201.

The conflict resolution process can be defined as the informal or formal process that two or more parties use to find a peaceful solution to their dispute. It's often the case that when two people or organizations try to resolve a dispute by determining who is right, they get stuck.

What Is A Resolution Meeting? A resolution meeting is a dispute resolution process that takes place after a parent files a due process complaint. Resolution meetings offer parents and school districts the opportunity to resolve issues before a due process hearing happens.

A resolution session is one way the law encourages parents and schools to work out their differences. The session is a mandatory meeting that happens at the start of due process. During the session, the school may try to negotiate with you and make an offer.

Making room for these innovations, the Court has determined that due process requires, at a minimum: (1) notice; (2) an opportunity to be heard; and (3) an impartial tribunal.

Due process is a formal way to resolve disputes with a school about your child's education. You can file a due process complaint only for special education disputes, not for general education issues. You have the right to an impartial hearing officer and to present evidence and witnesses at the due process hearing.

A “due process hearing” is the formal procedure used to decide disagreements between parents and a district. A hearing can take place if parents and a district cannot fix the problem without a hearing. Both parents and districts have the right to file a request for due process.

Under due process, every person has the right to his or her day in court. “Due process” in special education means the rights and procedures that apply to deciding disagreements between parents and districts. Special education due process procedures occur over a period of time. Each step builds upon the previous steps.
