On average, an uncontested divorce takes about four to six months.

There are 6 fault grounds for divorce in PA: adultery, desertion, cruel treatment, bigamy, imprisonment of more than 2 years, and indignities. The no-fault grounds for divorce in Pennsylvania are irretrievable breakdown and mutual consent. A person who initiates the divorce is called a Plaintiff.

Irretrievable breakdown The cause of the breakdown is legally termed as "irreconcilable differences" or "incompatible of temperament." This breakdown occurs through no fault of the spouses, without blame to one another, and commonly represents grounds for divorce.

Pennsylvania divorce lawyers will agree that fault divorces are generally harder and more expensive. Fault divorces are contentious, acrimonious, and lengthier than no-fault divorces since fault must be proven, meaning that hearings must be held before a Judge and evidence must be submitted.

You must be separated for more than 2 years in order to do a Pennsylvania Divorce without your spouse's signature. If your spouse can be served and he/she does not respond, you may be able to get your divorce without signature. Even after 2 years, your spouse could contest the case.

There are two types of no-fault divorce processes in Pennsylvania: mutual consent and separation. A mutual consent divorce is available when both parties are willing to agree that the marriage is irretrievably broken and consent to the divorce.

Grounds for Divorce After filing no-fault, you will be subjected to a 90-day waiting period before a judge will sign off on the divorce. Even with the waiting period, filing no-fault is quicker than filing on fault-based grounds (i.e. adultery, desertion, cruelty, bigamy, etc.).

A mutual split – where neither party takes blame for a marriage's dissolution – is called a no-fault divorce. There are two types of no-fault divorce in Pennsylvania. The most common, the mutual consent divorce, allows for a 90-day period after the divorce complaint has been served and consented to by both parties.
