On February 13, 2021, Toomey was one of seven Republican senators to vote to convict Donald Trump of incitement of insurrection in his second impeachment trial. After leaving office, Toomey joined the board of Apollo Global Management.

Each of the 50 states is equally represented by two senators who serve staggered terms of six years, for a total of 100 senators. From 1789 to 1913, senators were appointed by legislatures of the states they represented. They have been elected by popular vote since the 1913 ratification of the Seventeenth Amendment.

The district has elected Republican candidates for all but six years since 1979. During 1999–2005, Pat Toomey represented the district. From 2005 to 2018, fellow Republican Charlie Dent represented the district; in September 2017 he announced he would be retiring and not seek re-election in 2018.
