Section 1(1)(b) British Nationality Act 1981. Customers are entitled to be British citizens under section 1(1)(b) of the British Nationality Act 1981, if they meet both the following conditions: they were born in the UK on or after 1 January 1983 or in a qualifying overseas territory on or after 21 May 2002.

Before 1 January 1983 British women were not able to pass on citizenship to their children born abroad in the same way as British men. Children born before 1 January 1983 to British mothers can apply for registration as a British citizen under section 4C of the British Nationality Act 1981.

Section 4L was introduced to create a route to British citizenship where the Home Secretary considers you would have been, or would have been able to become, a British citizen, but for one or more of three specific reasons which are set out in statute and are explained in more detail below.

3 Acquisition by registration: minors. (1) If while a person is a minor an application is made for his registration as a British citizen, the Secretary of State may, if he thinks fit, cause him to be registered as such a citizen.

Our guidance on section 3(1) states that we would normally register where the child was born before the parent registered under section 4C and, had the parent been able to become a British citizen automatically, the child would be a British citizen or have an entitlement to be registered under section 3(2) or 3(5).

Summary. The British Nationality Act 1981 sets out who is a British citizen. Under that act, an individual who is born in the UK is a British citizen automatically from birth where one of their parents is British or settled here.

2.1 Under s. 2(1)(a), a person born outside the United Kingdom on or after 1 January 1983 and before 21 May 2002 is a British citizen at birth if, at the time of the birth, either parent (see Annex F to Chapter 6) is a British citizen "otherwise than by descent".
