The notice must be given if the construction contract is for more than $2,000, or if the sale of a new residence occurs within 75 days of the completion of construction. If the property owner who contracts for construction work is a licensed contractor, the notice does not have to be given.

For purposes of ORS 701.143 (Requirement for timely filing of complaints), “Substantial completion” occurs when a person in the position of the owner would reasonably conclude that the contractor had fulfilled its obligations under the contract and that final payment was due.

Completion Notices are issued on domestic properties, either new builds or those nearing structural completion. Completion Notices are served when a property is considered as structurally complete; or that remaining works can reasonably be expected to be completed within three months.

Licensing​ Oregon law requires anyone who works for compensation in any construction activity involving improvements to real property to be licensed with the Oregon Construction Contractors Board (CCB).

(18) Working without a construction permit in violation of ORS 701.098, $1,000 for the first offense; $2,000 and suspension of CCB license for three (3) months for the second offense; $5,000 and permanent revocation of CCB license for the third and subsequent offenses.

In Oregon, if work is being done on property at the direction of someone other than the owner (i.e., a tenant), the owner can avoid liability from any claims of liens by filing a “Notice of nonresponsibility.” The notice must be filed and posted in some conspicuous place on the site.
