Instructions to Stop a Sheriff's Sale Instructions to cancel or postpone the sale of a parcel on the day of sale must be submitted in person to the Civil Administrative Unit and will only be accepted prior to the parcel being offered for sale through Real Auction.

The Cuyahoga County Sheriff's Office is the primary law enforcement agency for Cuyahoga County, Ohio. The current interim sheriff is Joseph Greiner, who was named to the post on February 16, 2023. It provides correctional, civil, and law enforcement services to the county.

What happens to liens on the property? Liens are "Marshaled" (placed in order and paid in order), and paid from the sale proceeds. A "Deficiency Judgment" is granted to the Plaintiff (Lien holder) against the Defendant (Homeowner) if enough money is not generated at the sale. The liens are then canceled.

Once the sale has been confirmed, the deed will be drawn up and the buyer will pay the purchase price and record a new deed. At this point the buyer has possession of the property and you can be evicted. The buyer can request a Writ of Possession and the sheriff will generally give you 3-7 days to vacate the property.

The “Official Records Search” website now stores scanned copies of deeds, mortgages, leases and other property records, dating back to July of 1810, which residents can download for free and view at cuyahoga.oh.publicsearch.us. It also works in conjunction with the county's MyPlace property search website.

After the sale, what takes place is a “redemption period” in which the sheriff has 60 days to inform the court of the sale, and the court has another 30 days to validate the sale with a “writ of confirmation.” Once the sale has been confirmed, the purchaser has the right to occupy the property.

A deposit of $500.00 will be required to file a praecipe for order of sale. The filing of the praecipe will cause the clerk to issue an order of sale to the sheriff or to a private selling officer, if one has been appointed in the case. The property will then be appraised, advertised and sold at a public auction.

A sheriff's deed conveys title to the purchaser following a sheriff's sale. The sheriff must execute and record the deed in the same way grantors execute and record other Ohio deeds (see Ohio Deed Requirements and Recording the Sheriff's Deed).
