What Is a Sponsor Liable For? The sponsor who signs Form I-864 is legally bound by contract to provide financial support for the immigrant family member. This contract is between the United States government agency and the sponsor, including the main and secondary sponsor(s).

If you filed an immigrant visa petition for your relative, you must be the sponsor. You must also be at least 18 years old and a U.S. citizen or a permanent resident. You must have a domicile in the United States or a territory or possession of the United States.

In the Affidavit of Support sample, the sponsor has a household size of eight household members. The petitioning sponsor must complete and submit a signed Form I-864 for the intending immigrant even if there will also be a joint sponsor.

As a general rule, you'll need a separately prepared, original Form I-864 if the intending immigrant is the principal immigrant on Form I-130. Separate Affidavits of Support are required for intending immigrants for whom different Form I-130 family-based petitions were filed.
