How do I get a judgment lien on the debtor's real property? File a certified copy of your judgment in the real estate records of the county in which the property is located. The lien is in effect for 10 years, and it can be renewed for an additional ten years.

To attach a lien, the creditor must record the judgment with the county recorder in any Florida county where the debtor owns real estate now or may own real estate in future. For liens on personal property, the creditor files the judgment with the Florida Department of State.

How do I get a judgment lien on the debtor's real property? File a certified copy of your judgment in the real estate records of the county in which the property is located. The lien is in effect for 10 years, and it can be renewed for an additional ten years.

There are only four ways to get rid of a judgment: Pay the judgment in full. Settle the judgment with the creditor. Discharge the judgment in bankruptcy (Chapter 7 or Chapter 13 for individuals).

The lien is good for 10 years, but the creditor can renew the judgment before it expires for another 10 years, meaning the lien will survive for a maximum of 20 years. The good news is that because of Florida's homestead protections, a judgment lien cannot attach to homestead property.

If you are married, any marital property held in both the husband and wife's name is exempt from the creditors of the other. You will have to file an affidavit with the court to claim this exemption however and this exemption cannot be fraudulent to simply try and protect the property from the creditors.
