When you file exempt with your employer, however, this means that you will not make any tax payments whatsoever throughout the tax year. Therefore, you will not qualify for a tax refund unless you are issued a refundable tax credit.

Filing as “exempt” is not illegal. If you meet the criteria for filing as exempt you should file exempt on your W-4. Even if you qualify for a federal tax exemption, your employer will still withhold Social Security and Medicare taxes.

To claim the exemption, the buyer or their agent must provide the vendor with: A signed copy of Sales Tax Exempt Purchaser Certificate (Form ST-5) or Contractor's Sales Tax Exempt Purchase Certificate (Form ST-5C), and. A copy of the organization's Certificate of Exemption (Form ST-2) issued by DOR.

When you file exempt with your employer for federal tax withholding, you do not make any tax payments during the year. Without paying tax, you do not qualify for a tax refund unless you qualify to claim a refundable tax credit, like the Earned Income Tax Credit.

An exemption from withholding is only good for one year. Employees must give you a new W-4 each year to keep or end the exemption. If the exemption expires, withhold federal income tax ing to the employee's Form W-4 information.
