Generally, the creditor must file a lawsuit, obtain a judgement from the court, then apply for a separate garnishing order. If the creditor is filing for a debt owed, then they can receive a garnishing order before a judgement is made and at times even before the lawsuit is completed.

You fill out a Notice of Garnishment [Form 20E]. If there is more than one garnishee, you must fill out a separate notice of garnishment and affidavit for enforcement request for each garnishee.

The Creditor and the Court The process begins when an employee owes a debt to a creditor. The creditor follows a garnishing process to obtain the amount owed to them. The creditor must go to court to get a judgment against the debtor to establish that a debt is owed, and then separately apply for a garnishing order.

If your wages are garnished, there's a limit to how much of your wages a creditor can take. Usually, that limit is 30% of your net income. However, if the creditor is claiming spousal or child support payments, they can take up to 50%. A garnishing order applies only to wages payable within the next seven days.

In line with the Ontario Wages Act, a creditor can only garnish up to 20% of your wages, or up to 50% for child support. The court will ultimately make this decision based on your unique financial circumstances.
