How do I find out if a substance is on the Inventory? Someone with a valid commercial need for EPA to verify if a substance is on the inventory can submit a Bona Fide Intent to Manufacture or Import Notice (“bona fide notice”) to obtain a written determination from EPA.

Positive Certification Statement: "I certify that all chemical substances in this shipment comply with all applicable rules or orders under TSCA and that I am not offering a chemical substance for entry in violation of TSCA or any applicable rule or order thereunder."

The Principal Investigator, Lab Manager or Researcher must fill out the TSCA Import Certification Form which will accompany the purchase order that lists the chemical names.

TSCA Compliance Chemical Restrictions Obligations regarding TSCA can be simplified into three key aspects. Companies must: Document the use of restricted substances in parts, materials, and products, and retain the documentation for a minimum of three years. Communicate the presence of banned substances to customers.

Section 8(e) of the Toxic Substances Control Act (TSCA) requires that EPA be immediately notified when substances or mixtures present a substantial risk of injury to health or the environment.

Toxic substances subject to TSCA regulation include PCBs, asbestos, lead, mercury, formaldehyde, and certain hexavalent chromium compounds. Operations at Federal facilities typically involve management of toxic substances regulated under TSCA.

Fill out the date and the tracking (waybill) number of your order. Include any relevant information such as certifier name (yourself), certifier phone number, email address, and signature. List any items that may contain chemicals.

Customs can refuse entry of any shipment that does not have a TSCA certification. TSCA certificate is not required for articles and tobacco products. For other chemicals, you may follow the picture below to determine whether you need a positive certification or a negative certification.
