However, employers should only ever use one form or the other, depending on their circumstances. In a given year, an employer should never be filing both forms for the same reporting period.

The employer is also obligated to report his contributions to Medicare and Social Security. Once you register yourself as an employer with the IRS, it's pretty difficult for you to qualify not to file Form 944, even if you don't have a single employee.

Form 944 is designed so the smallest employers (those whose annual liability for social security, Medicare, and withheld federal income taxes is $1,000 or less) will file and pay these taxes only once a year instead of every quarter. These instructions give you some background information about Form 944.

IRS Form 944 - Employer's Annual Federal Tax Return was initiated by the IRS several years ago to give smaller employers a break in filing and paying federal payroll taxes (federal income tax withheld from employees, and Social Security and Medicare payments owed by employers and employees).

All corporations are required to file a corporate tax return, even if they do not have any income. Thus, if an LLC has elected to be treated as a corporation for tax purposes, it must file a federal income tax return even if the LLC did not engage in any business during the year.

Generally, employers are required to file Forms 941 quarterly. However, some small employers (those whose annual liability for social security, Medicare, and withheld federal income taxes is $1,000 or less for the year) may file Form 944, Employer's ANNUAL Federal Tax Return annually instead of Forms 941.

Certain small employers that pay wages to employees and withhold taxes must file a 944 form on an annual basis. The IRS will notify you if you are eligible to file Form 944. If you do not receive notification, you must file Form 941 quarterly.
