What is a For Sale By Owner Contract? For Sale By Owner (FSBO) contract is a legally binding document used when selling a property by owner. A typical Tennessee FSBO contract contains the name of the buyer and the seller, contract date, property description, terms of payment, contingencies, etc.

In Tennessee, a seller can get out of a real estate contract if the buyer's contingencies are not met—these include financial, appraisal, inspection, insurance, or home sale contingencies agreed to in the contract. Sellers might have additional exit opportunities with unique situations also such as an estate sale.

If the contract does not have the detachable form, you may still cancel by writing the seller. Your notice or cancellation must be sent in by midnight of the third business day after signing the contract. If you mail the cancellation, it must be postmarked by the third business day.

The Listing Agent binds the offer. The last party to receive the acceptance of the offer/counter offer is the one who binds the agreement.

Most real estate contracts have contingencies that give sellers cause to back out. For instance, the seller may say they will only sell their property if they can purchase a new home for themselves within 30 days. If they are unable to find a property, they can cancel the sale of their current home per the contract.

Tennessee law permits, under certain circumstances, a buyer of real estate to rescind a real estate contract and to recover any monies paid towards the real estate. If a Tennessee court allows rescission, the buyer will receive, at least, the amount he or she paid for the property.
