The Judicial Council adopts legal forms in one of two ways. Under Government Code section 68511, the council may "prescribe" certain forms. Use of those forms is mandatory. The council may also "approve" forms.

If your landlord files an unlawful detainer against you, they are essentially telling the court that you have not complied with your lease or that you did not pay your rent within 30 days. The tenant has to be served with the unlawful detainer notice within 10 days after the filing.

California passed a new landlord-tenant law that will provide additional protections for renters around just cause evictions. Set to take effect on April 1, 2024, the law will require landlords to have just cause to terminate tenancy after a tenant has been placed in the unit for 12 months.

If the judge decides you have to move The court will give the landlord a Judgment of Possession (form UD-110). This gives the landlord control (possession) of the property. Then, the landlord will fill it out and have the court clerk issue a Writ of Execution (form EJ-130). They take the Writ to the sheriff's office.

As of July 1, 2022, plaintiff is not required to make the allegations in item 3 of form UD-101 and is not required to apply for rental assistance or verify that no application is pending prior to initiating an action for unlawful detainer. All plaintiffs in unlawful detainer proceedings must file and serve this form.

An Unlawful Detainer, more commonly known as an eviction, is used when a landlord wants to get tenants out of a rental property - either commercial or residential. Only a sheriff can evict someone. Even if a tenant is months behind on rent, the landlord cannot evict the tenant or get rid of the tenant's belongings.

No-fault evictions are prohibited, so landlords can't evict a tenant without cause. If a landlord ends a tenancy agreement to move back into the home, it can't be put back on the rental market within 12 months. Landlords can't end a tenancy to remodel the rental property without supplying details of planned works.
