North Carolina has a flat income tax rate, which means residents pay the same individual income tax rate regardless of income level. Under recent tax changes, North Carolina's individual income tax rate will decrease every year until it reaches 3.99 percent for tax year 2026. The rate for tax year 2024 was 4.5 percent.

How to Calculate Net Operating Loss (NOL) Net operating loss is calculated by subtracting allowable tax deductions from taxable income. If the resulting figure is negative, there's a net operating loss. When this happens, the business can carry some of its tax deductions forward to years when it has a profit.

A partnership doing business in North Carolina that is required to file a federal partnership return must file a N.C. partnership tax return, Form D-403, for the taxable year.

Under N.C. Gen. Stat. § 20-35, an NOL is a traffic infraction, not a criminal offense. Generally, penalties include a fine of up to $100, plus court costs, 3 points on your driving record, and 1 point on your insurance record.

Form D-400V is the payment voucher that you must use if you owe tax when you file your individual income tax form (Form D-400). This payment voucher allows the Department to process your payment accurately and efficiently with fewer errors.

However, if the nonresident partner is not an individual or a grantor trust, the partnership is not required to pay the tax if the partner timely completes a Nonresident Partner Affirmation (“Form NC-NPA”).

How It Works. The rules state that the amount of the NOL is limited to 80% of the excess of taxable income without respect to any § 199A (QBI), § 250 (GILTI), or the NOL. For example: In this example, tax is paid on $20,000 of income even though there was an NOL carryover more than the current year's income.
