You should not have to file the Form I-864 when you are filing the Form I-130 petition since the beneficiary is outside the US. However, when CIS approves the I-130 , your next step is to file immigrant visa applications with the NVC.

Starting January 1, 2017, the National Visa Center (NVC) will accept photocopies and scanned versions of signed Forms I-864 and associated documents. Please note that the form must still be signed; typed names and electronic signatures will not be accepted.

First Preference: Unmarried, adult sons and daughters of U.S. citizens (Adult means 21 years of age or older) Second Preference: Spouses of permanent residents and the unmarried sons and daughters (regardless of age) of permanent residents and their unmarried children.

For U.S. citizens or U.S. nationals, a copy of your birth certificate, passport, or certificate of naturalization or citizenship. For lawful permanent residents, a copy of both sides of your Form I-551, Permanent Resident Card.

The form does NOT have to be notarized. The sponsor must sign the form, even if a joint sponsor also submits an I-864 to meet the income requirement. However, when signing the form, under the penalty of perjury, the sponsor certifies that all the information and documents provided are true and correct.

For example, in 2020, a sponsor in the U.S. mainland would need to have income (or assets) of at least $32,750 to cover a petitioner who lives alone and is sponsoring one immigrant and two children (that is, a total of four people).

Income Requirements You must show that your household income is equal to or higher than 125% of the U.S. poverty level for your household size. (Your household size includes you, your dependents, any relatives living with you, and the immigrants you are sponsoring.)
