Florida Statute 689.041 defines Scrivener's Errors as: A single error or omission in a lot or block (transposition counts as one error); A single error or omission in no more than one of a unit, building or phase of a condominium or cooperative unit; or.

A scrivener's affidavit is an affidavit made by a scrivener or (in more modern terms) the preparer of the deed. In layman's terms, when a deed has certain technical defects or factual inaccuracies, a scrivener's affidavit is a good way to fix those defects and inaccuracies.

A corrective affidavit is a statutory device under Cal. Gov. Code 27201, used to correct a minor error in a document that has been recorded at an earlier date. Minor errors are those that, when corrected, cause no actual change in the substance of the document.

Scriver's Affidavit: NCGS § 47-36.1 allows practitioners to provide notice of errors in recorded instruments. On its face, the statute applies to “non-material typographical or other minor errors.” The statute applies to deeds and other recorded instruments.

Draft a corrective deed, affidavit, or new deed. Obtain the original signature(s) of the Grantor(s). Re-execute the deed with proper notarization and witnessing.

Scrivener's Affidavits are sworn statements by the person who drafted a deed. Unlike a Corrective Deed, a Scrivener's Affidavit doesn't correct anything. Instead, it simply adds information to the property records to help clarify something about the prior deed.
