Your lender can use self-help repossession to take your vehicle. That means the lender doesn't need a court order to do it. Repossession companies don't need a special business license, but to tow your vehicle, they need to be licensed as a wrecker service through the Oklahoma Department of Public Safety.

A financial institution can only repossess your vehicle if there is a “default” and that the financial institution has a good faith belief that the prospect of payment or performance is impaired. Usually, vehicles get repossessed for a failure to make payments or failure to maintain automobile insurance on the vehicle.

Upon each vehicle repossessed by a mortgagee, a fee of Forty-six Dollars ($46.00) shall be assessed. This fee shall be in lieu of any applicable vehicle excise tax and registration fees.

If the repo company can't repossess the car without breaching the peace, then the lender can go to court and go through the replevin process. The lender is basically taking you to court to make you hand over the car. If you lose the court case, then you have to return the car by the scheduled date.

It takes time, money, and effort to repossess a car. So, although in Oklahoma, the lender has the right to repossess the vehicle after only 30 days, most lenders won't proceed with repossession until you miss two or three consecutive payments.
