The Massachusetts Uniform Enforcement of Foreign Judgments Act – Enacted in 2019 and codified as M.G.L. c. 218, § 4A – sought to bring the Bay State in line with a growing majority of states (47 and counting) regarding the process for enforcing civil judgments obtained in other states.

The first is through the enactment of the Uniform Foreign Judgment Enforcement Act which requires the filing of an exemplified judgment, an affidavit complying with the statute and a filing fee. The court will then give notice to the defendant and after thirty days will enter the judgment.

Enforcement of a Foreign Judgment in the U.S. Under U.S. law, an individual seeking to enforce a foreign judgment, decree or order in this country must file suit before a competent court. The court will determine whether to recognize and enforce the foreign judgment.

The Foreign Judgments (Reciprocal Enforcement) Act 1933 (FJA 1933) covers judgments or orders made by a recognised court in civil proceed- ings or criminal proceedings for a sum of money in respect of compensation or damages to an injured party, as long as it is not in respect of a tax, fine or penalty.

The Uniform Act attempts to resolve such problems as finality, jurisdiction, and due process, while achieving a measure of uniform treatment for the recognition and enforcement of foreign judgments in United States courts.

Separation of recognition and enforcement Generally speaking, a foreign judgment will have no direct operation and cannot be immediately enforced until it has been recognised. The party seeking to enforce a foreign judgment must therefore first apply to a court to have it recognised.
