How Much Leave Is Available? Employees in Texas may take up to 12 weeks of leave in a 12-month period for a serious health condition, bonding with a new child, or qualifying exigencies. This leave renews every 12 months, as long as the employee continues to meet the eligibility requirements set out above.

While employers cannot ask about the specifics of your illness, they can inquire about your general ability to perform your job duties. For example, they may ask if you are able to come to work or if you require any accommodations.

Medical information is considered personal and confidential, and an employer must respect an employee's privacy. Therefore, if you feel uncomfortable disclosing information about your illness or injury, you can simply state that you are sick and cannot come to work.

In terms of sick leave, unless it fell under the Family Medical Leave Act (FMLA) or a disability where the employer has granted you an accommodation, they can terminate you or any other employee for calling in sick.

While your employer is allowed to ask why you are sick, they are not entitled to specific medical information. You are only required to provide enough information to establish that you are unable to work.

Texas does not have a state law making it mandatory for private sector employers to provide paid or unpaid sick leave. Public sector employers, however, must give their employees sick leave at the rate of eight hours per one month of employment for full-time employees.

No current Texas or federal law requires private-sector employers to provide paid or unpaid leave of any kind, although some amount of unpaid leave may be necessary as a reasonable accommodation in the event of a disability, pregnancy, or other condition protected under a specific statute.

Sick Leave Pool – An employee becomes eligible to withdraw time from the sick leave pool if the employee has exhausted his or her sick leave because of a catastrophic illness or injury of the employee or of a member of the employee's immediate family (see the definition of “immediate family”).

If an employee wishes to take more than three days of paid sick leave, they must provide a doctor's certificate stating the reason for their absence.
