Abandonment: Upon ceasing to transact business in this state under a fictitious business name that was filed in the previous five years, a person who has filed a fictitious business name statement shall file a statement of abandonment of use of fictitious business name.

You will want to check the county clerk/recorder's office where the business is to find out the business owner's name. You will be looking up Fictitious Business Name (FBN) records. The records will show that the business could be owned by a person or another type of business.

Abandonment of a Fictitious Business Name Statement Purpose: The make available to the public a statement by persons or business entities no longer doing business under a previously filed fictitious business name. The Statement of Abandonment must be filed on an active Fictitious Business Name Statement.

The Statement of Abandonment of fictitious business name must be published in a newspaper once a week for four successive weeks and an affidavit of publication filed with the county clerk within 30 days after publication has been accomplished.

A fictitious business name statement expires five years from the date it is filed in the County Clerk. A refile of a fictitious business name statement must be filed prior to the date of expiration if you intend to continue doing business under that name and if there are no changes from the original.

Failure to publish as required by law will cause your statement to expire, and will require a new statement to be filed, including the payment of ANOTHER filing fee.

If you're closing your business and no longer plan to use your business name (Fictitious Business Name), you may submit a Statement of Abandonment of Use of Fictitious Business Name with the County Clerk.

After your statement has been filed, publishing is required under the following circumstances (Business and Professions Code 17917): A new Fictitious Business Name Statement filing.
