In Gideon v. Wainwright, 1963, the U.S. Supreme Court ruled that counsel must be provided to indigent defendants in felony cases. This decision placed the cost for legal counsel on the government in instances where the defendant is unable to afford legal representation.

§ 7A-450. Indigency; definition; entitlement; determination; change of status. (a) An indigent person is a person who is financially unable to secure legal representation and to provide all other necessary expenses of representation in an action or proceeding enumerated in this Subchapter.

Indigent defense is then typically provided through one or a combination of three methods: a public defender office, an assigned counsel system, or a contract system.

An indigent person is extremely poor, lacking the basic resources of a normal life. Often the indigent lack not only money but homes. Indigent comes from a Latin word meaning wanting, which we used to use to mean “lacking” and not just to describe desires.

In Gideon v. Wainwright (1963), the Supreme Court ruled that the Constitution requires the states to provide defense attorneys to criminal defendants charged with serious offenses who cannot afford lawyers themselves. The case began with the 1961 arrest of Clarence Earl Gideon.

The government is required to provide and pay for attorneys for those individuals who are unable to afford private attorneys. This is known as “indigent defense.”

Indigent defense involves the use of publicly financed counsel to represent criminal defendants who are unable to afford private counsel. At the end of their case approximately 66% of felony Federal defendants and 82% of felony defendants in large State courts were represented by public defenders or assigned counsel.
