The Voluntary Acknowledgment of Paternity form shall accompany the birth certificate to the Office of Vital Statistics where the father's name will be added to the birth certificate. A copy of the Voluntary Acknowledgment of Paternity form will then be forwarded to the Division of Child Support Enforcement.

The hospital should have a notary public on staff. Once both parents have signed the VAP, the father's name is added to the birth certificate and the hospital sends it to the local Health Department. The Health Department sends the certificate to the Kentucky Office of Vital Statistics.

If all three parties (mother, husband and child's father) are willing, they may complete a Three-Way Paternity Affidavit (VS-8C). This form allows the husband to deny that he is the father of the child and then allows the mother and the child's biological father to acknowledge paternity.

When a child is born to unmarried parents in Kentucky, paternity must be established before the father has any rights to visitation or custody. However, if a man is listed on the child's birth certificate, the Court will then assume that that named individual is the child's biological father.

Unmarried parents can sign a form called the Voluntary Acknowledgment of Paternity (AOP) prior to discharge from the hospital. This is a no cost at the hospital. Unmarried parents are provided a simple and convenient method in Virginia to place the father's name on the child's birth certificate.

The child's birth certificate will include both parents' names. The legal father of the child may qualify for benefits from medical insurance, Social Security, state, federal and inheritance benefits. If the mother passes away unexpectedly, the father is then able to take measures to secure child custody.

A court order will be required in order to make any changes to the record. Normally an attorney is needed for this type of action. If the mother was married to another man during the child's conception or birth and there is no father listed on the child's certificate, a three-way paternity affidavit can be filled out.
